Please read these Terms of Service ("Terms") carefully before using the website at pavethewaysealcoating.com or requesting services from Pave The Way Seal Coating ("Company," "we," "our," or "us"), located in Katy, TX.

By accessing our website or requesting services, you agree to be bound by these Terms. If you do not agree, please do not use our website or request services.

1. Services

Pave The Way Seal Coating provides professional asphalt maintenance services including seal coating, driveway sealing, parking lot sealing, crack filling, asphalt repair, and line striping throughout Katy, TX and the greater Houston area.

All services are subject to a written estimate and a signed work authorization prior to any work beginning. Prices quoted in estimates are valid for 30 days from the date of the estimate. We reserve the right to revise pricing after 30 days due to changes in material costs or labor availability.

Work is scheduled subject to weather conditions, material availability, and crew scheduling. We will make reasonable efforts to complete work on the scheduled date, but we reserve the right to reschedule due to inclement weather or other circumstances outside our control.

2. Estimates and Quotes

Written estimates are provided free of charge and without obligation. An estimate is not a binding contract. Work commences only upon your written authorization of the scope and price stated in the estimate.

If additional work is discovered during service that was not identified during the estimate process (such as hidden base damage revealed after cleaning), we will notify you and obtain authorization before proceeding with the additional work. We will never perform work beyond the authorized scope without your approval.

3. Customer Responsibilities

To ensure a successful service, you agree to:

• Ensure the work area is accessible on the scheduled service date (vehicles moved, gates unlocked)
• Keep people, pets, and vehicles off the sealed surface for the curing period specified in your job completion notice (typically 24–48 hours)
• Notify us of any known underground utilities, irrigation lines, or drainage structures near the work area prior to service
• Ensure that payment is available upon job completion as agreed

We are not responsible for damage caused by vehicles or other objects placed on sealed surfaces before the required curing period has elapsed.

4. Payment Terms

Payment is due upon completion of the work unless alternative payment arrangements have been agreed to in writing prior to service. We accept cash, check, and major credit cards (Visa, Mastercard, American Express, Discover).

For commercial or large-scale jobs, a deposit of up to 50% of the estimated project cost may be required before work begins. This will be specified in your estimate and work authorization.

Invoices not paid within 30 days of the completion date may be subject to a late fee of 1.5% per month on the outstanding balance, and collection costs including reasonable attorney's fees if legal action becomes necessary.

5. Workmanship Warranty

We warrant our workmanship against defects in application for one (1) year from the date of service. If a defect in our application is identified within this warranty period, we will return to evaluate the issue and remedy it at no charge if the defect is attributable to our work.

This warranty does not cover:

• Normal wear and weathering of seal coat material over time
• Damage caused by heavy vehicle traffic, oil spills, or chemical exposure after service
• Cracking or damage caused by underlying structural issues, base failure, or soil movement
• Damage caused by failure to follow post-service care instructions (such as driving on the surface before curing is complete)
• Any pre-existing conditions identified in the estimate or work authorization

Seal coat material performance depends on weather conditions, surface preparation, and maintenance practices that are partially outside our control. Material manufacturers provide no warranty on residential applications.

6. Limitation of Liability

To the maximum extent permitted by applicable law, Pave The Way Seal Coating shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to our services or your use of our website. Our total liability for any claim arising from services rendered shall not exceed the total amount paid by you for the specific service giving rise to the claim.

7. Website Use

The content on our website — including text, images, graphics, and logos — is owned by or licensed to Pave The Way Seal Coating and is protected by applicable copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without our written permission.

You agree to use our website only for lawful purposes and in a manner that does not infringe the rights of others or restrict or inhibit anyone else's use of the website.

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Fort Bend County or Harris County, Texas.
